# General rental terms & conditions of Iaorana Agency
## Purpose of the Agreement
The purpose of this document is to define and to list the short term rental's general conditions.
### Article 1. Description of rented premises
All the rentals proposed by Iaorana Agency, have been visited at least once by our services. Descriptions are fully and faithfully summarized on our website. If in spite of such multiple precautions, your rental did not match the given description, Iaorana Agency may not be held responsible for a defect due to the owner's concealment, omission, hidden defect, etc.
Conversely, Iaorana Agency, acting as an agent may not be held responsible if modifications affecting the rented property, its environment or its availability, had not been communicated to Iaorana Agency by the owner before the reservation date, or between the reservation date and the arrival date.
The number of persons occupying the rental must absolutely not exceed the number mentioned on the invoice. Should the number of planned occupants be higher, the RENTER promises to ask for Iaorana Agency's prior agreement. The number of guests should not exceed the number confirmed on your booking. Any additional person unauthorized by Iaorana Agency will be invoiced as a supplement.
These premises are to be used for accommodation purposes only. The property is not a function centre or venue. No functions/parties are permitted. Any unauthorized use will result in immediate eviction with no refund of monies paid.
### Article 2. Rental's duration
The stay may not exceed the number of nights indicated on the invoice, except in case of written agreement by Iaorana Agency. The total amount of rent shall remain acquired by Iaorana Agency should the RENTER decide to shorten the length of his rental.
At the beginning of the rental period, Iaorana Agency or its Agent shall give to the RENTER the keys and the instructions relative to the property.
The RENTER may not, under any circumstances, claim a right to remain in the rental property at the expiration of the rental period covered in this contract. In case of unauthorized excess of the rental period of more than two (2) hours relative to the date and time indicated on the invoice, a full night shall be invoiced to the RENTER.
-Arrivals / Departures
Unless specified, check-in time is 3:00 pm or 2:00 pm for some properties. When you make reservation, we will ask you to tell us your exact arrival time, so one of our agents can wait for you on the premises. Should you be late, we will ask you to inform us so that we can reschedule. In addition to the contract, we will give you directions or a meeting point, and the phone number of the person to notify in case of delay. A supplement of 50€ will be charged if you arrive after 6:00 pm.
Unless specified, the departure check out/return of the keys must take place before 11:00 am or 10:00 am for some properties. At a time agreed upon (at your arrival), our representative will meet you on site to inspect the premises and receive the keys. Should the property not be occupied on the following night we give you the possibility to remain later with a supplement of 100€ (11 900 XPF). In order to plan our schedule, please contact our services. They will let you know if you can stay or not.
The RENTER must give back the keys to our agent (or leave it to any other place indicated in the notice) at time of the check out. In the case of missing keys, a fixed fee of 100 € will be deducted from the RENTER's credit card.
### Article 3. Rent and payment
To obtain the total amount for the agreed upon rental, please see your invoice.
A down payment of FIFHTY percent (50%) of the overall amount of your rental must be paid at the time of reservation in order to confirm that reservation and the balance is due 7 days prior arrival.
The payment may be paid in various ways:

In case of bank transfer or check, the reservation will be kept for 72h while waiting for the payment. After 72h, if payment has not been made, the reservation is cancelled and the property's availability will no longer be guaranteed. For a bank transfer, we need to receive the correct amount in XPF: the bank transfer fees and exchange rate fees are at your own expenses.
As soon as the down payment is received, an email will confirm the reservation and its details.
The RENTER promises then to pay the balance of the rental amount to Iaorana Agency within a maximum period of SEVEN (7) days before the scheduled arrival time.
-Reservation less than 7 days before the date of arrival:
If the reservation is made less than 7 days before the date of arrival in the premises, payment in full for the rental will be required at the time of reservation, unless specified or agreed with Iaorana Agency.
No key will be given without full payment for your stay.
Our prices include (except if otherwise specified):
* Flat rate per month depending on the type of property:
- studio / 1 bedroom = 12 000 FCP/ month (<13 kW/ h / day)
- 2 and 3 bedrooms = 20 000 FCP/ month (house 25 000 FCP) (18 kW/ h / day)
- 4 bedrooms and more = 30 000 FCP/ month (house 35 000 FCP) (30 kW/ h / day)
The extra consumption will be charged in addition, the statement of the meter will be made on the arrival and the departure of the customers.

For long stay, such as few months, a monthly rent and special payment conditions may apply please contact us.
The RENTER will provide Iaorana Agency with his credit card details for a security deposit. This security deposit will be held until 2 weeks after the RENTER's departure date to leave Iaorana Agencyenough time to inspect the property, this deposit is not charged.
For this purpose, the RENTER will fill out and sign an authorization to debit his bank card at the time of reservation. If the the form is not signed, the bank card used for the payment of the reservation will be used as a means of payment to cover the amount of the security deposit in the event of damage or excessive electricity consumption.
The purpose of the security deposit is to cover repairs, reconditioning or loss of equipment (house linens as follows or furniture…) or extra electricity consumption.
If no degradation is noticed during the exit inspection, Iaorana Agency will destroy the RENTER's security deposit credit card details within 15 day after the check-out date..
In the opposite case, is any damage has been made or any item is missing, Iaorana Agency has 3 months to charge the RENTER's credit card of the total amount of the charge equivalent to the damages plus 10%.
Household and bed linens:
When applicable, if items are missing or damaged, you will be charged the following amounts:
Double bed sheet – 34 € or 4,050 XPF
White bath towel – 25 € or 3,000 XPF
Big beach towel – 420 € or 5,000 XPF
Blanket / duvet – 200 € or 23,866 XPF
Small white towel – 6 € or 695 XPF
Pillowcase – 4 € or 415 XPF
Bath mat – 8 € ou 950 XPF
Napkin – 2 € or 210 XPF
Dish towel – 5 € or 550 XPF
In addition to the cost of the item replacement an extra fee of 5000 XPF will be charged.
* Some items may not be featured in your rental, please check the property inventory.
### Article 4. Iaorana Agency's duties :
The main duties of Iaorana Agency are as follows:
– To deliver to the RENTER the premises in good condition of use and repairs, as well as the equipments mentioned in the contract in good operating condition
– To ensure for the RENTER a peaceful enjoyment of the premises (Iaorana Agency cannot be held responsible for the hidden faults, nonconformities or defects hidden by the owners);
No responsibility is taken for personal items left on premises during or after departure. Iaorana Agency does not accept liability for any injury, damage, loss of additional expenses caused directly or indirectly by events, which are beyond our control. We do not accept liability for errors, omissions, default or negligence represented on our website.
### Article 5. RENTER's duties :
The RENTER promises to occupy the property only for private purposes during his leisure or professional related stay. Under no circumstances, the property is to be used for commercial, artisanal or professional activities, no event or party is allowed.
The property must be occupied by the signers of this contract and the persons accompanying him within the limit of the number of persons that the property can accommodate.
Animals are welcome only in as much as their presence has been requested and accepted during the inscription.
The RENTER and the persons with him promise that they would not engage in any action that could affect the tranquillity of other occupants of the building, the neighborhood, the parcelling and in general of his neighbors. Co-ownership rules apply to the RENTER.
The RENTER also promises not to welcome or let anyone bring any nuisance to the neighborhood. The sound level of musical reproduction devices, of radio and television must be adjusted so as not to disturb the neighbors. In any case all noises, regardless of their cause, are forbidden from 10:00 pm to 7:00 am. To not use any machines or devices, which could bring to the neighborhood any nuisances such as bad odors, filthiness, vibrations, trepidations and noises or of any other manner.
The RENTER shall take the rented premises in their present condition and shall maintain them in good condition of rent related repairs during the entire duration of this contact. He/she will be held responsible for degradations and losses occurring during the duration of the contract in the promises of which he/she has the exclusive enjoyment, unless he/she proves that they occurred in a case of force majeure, by Iaorana Agency's fault or by the action of third parties who were not invited in the premises.
The replacement, repair or the servicing of materiel or accessories attached to the rented property are the exclusive responsibility of the RENTER if he/she is responsible of such loss or deterioration.
Any degradation, intentional or not, caused by the RENTER during his/her stay will be invoiced to him/her.
The RENTER shall not have any recourse against Iaorana Agency in case of theft and depredations in the rented premises.
Iaorana Agency cannot be held responsible for water, gas or electricity shut-offs, for theft or damages to personal property and for nuisances from the neighbors.
The RENTER cannot use the telephone or connect a handset receiver to the telephone line of the rental. If he/she uses the telephone line of the property, a penalty of 200 € will be charged from the RENTER's credit card.
The RENTER's duty is to return the property in the condition in which he/she found it. The property subject of this contract must be returned in the condition in which it was delivered to the RENTER.
In all cases, even if the RENTER has pre paid an exit cleaning or if the housekeeping service is included in the price, the RENTER must clean and tidy up the dinnerware, put all waste outside of the property and put the linens together or put them into the washing machine or even better clean them before departure.
- a flat rate of 200 € (or 25,000 XPF) relating to the restoration will be invoiced to the Customer if the property is returned in a proven state of dirt and disorder, noted by photo.
- a flat rate of 50 € (or XPF 6,000) will be invoiced to the Customer if the customer fails to empty the fridge and/or take out the bins.
### Article 6. Premises condition report and inventory
The property is provided in good condition. The client, upon entering the property, has 48 hours to report any defects or problems. If the CLIENT fails to report any defects or problems within this 48 hour period, any damage will be considered to be caused by the CLIENT and will be invoiced accordingly.
### Article 7. Insurance
The CUSTOMER agrees to be insured and to provide "IAORANA AGENCY" upon request, with a certificate of Civil Liability insurance (covering damage caused by carelessness or negligence) or a certificate of holiday insurance, or to provide it upon request.
In the event that the CLIENT is unable to provide a certificate of civil liability insurance, he/she will be obliged to take out comprehensive insurance and to provide proof thereof. "IAORANA AGENCY" offers this service as an additional charge.
### Article 8. Rental modification – cancellation:
These are modifications to the date of arrival or departure. If such modification occurs 30 days before the schedule date of arrival you will not be charged. If the modification occurs less than 15 days and given our cancellation policy below, you will be charged an additional cost of 50€ / 6 000 XPF.
In the event of cancellation of this seasonal rental contract by the customer, the latter undertakes to notify its decision to "IAORANA AGENCY" as soon as possible by registered letter with acknowledgment of receipt or by email, no cancellation or modification shall be made by phone. You will be charged a fee of 2% of the amount paid.
Deadlines, modification and reimbursement:
< 30 days: modification and refund without fees
< 15 days: modification and refund with fees
< 7 days: modification with fees & non-refundable
*modification upon availabilty.
Modification fees: 30€.
Cancellation fees: 2% of the invoiced amount
THE CUSTOMER can take out cancellation insurance to be reimbursed in the event of force majeure. Upon receipt of the cancellation, this contract will be deemed to be automatically terminated and "IAORANA AGENCY" may dispose of the rented property.
No refund will be given for early or unscheduled departure.
When receiving the cancellation, the present contract shall be deemed null and void with full rights and Iaorana Agency may dispose of the rented property.
We do recommend to The RENTER to subscribe a cancellation insurance to be reimbursed.
In case unforeseen circumstances (fire – damages – burglary – sale, etc.) make the property subject of this contract inaccessible, Iaorana Agency promises to relocate you in a property of identical or superior category located as close as possible to the property that you would have chosen, without changing anything in terms of date or price. If such exchange cannot be done, the total of the sum received by us will be reimbursed to you. Iaorana Agency may, under no circumstance, be subjected to an indemnity claim.
### Article 9. Cancellation of the contract
This contract shall be deemed cancelled with full rights and Iaorana Agency may dispose of the rented property:
-Should the RENTER fail to show up after 6:00pm on the scheduled date of arrival and in the absence of late arrival notification;
-Should the RENTER fail to pay the balance of the rent or the security deposit at the latest 7 (SEVEN) days before arrival date.
-In the case of a cancellation of the contract by the RENTER
### Article 10. Inclusive indemnities in case of legal actio
Any legal action shall be charged to the RENTER.
### Article 11. Dispute settlement
In case of dispute over this contract, or for all dispute arising from its execution, only the tribunals of French Polynesia shall have jurisdiction.
### Article 12. Declaration of residence.
For the execution of this contract and its following documents, the parties declare residency in their indicated home office and residence.
Civil liability waiver - acceptance
The RENTER :
« I declare, in the event of an accident of any kind or damage without exception or reservation, caused by me and / or persons under my responsibility, others, animals, vehicles and generally any objects and property made available to me in the Leased premises.
I hereby declare that I have subscribed a Civil Liability insurance, assuring me against all claims of any kind whatsoever, caused to myself or to third parties and that my insurance contract does not Does not mention any clause contrary to what previously stated.
I am aware that the canoe, bicycle (s), kayak, and all other nautical and terrestrial outdoor equipment to my disposal in the property rented during my stay are hazardous and present dangers inherent in their use.
Aware of the risks, I accept them with full knowledge of the facts and declare to renounce all recourse, sue or claim against the company "Iaorana Agency" represented by its manager and against the owners of the rented property. »
THE RENTER agrees to send with the attached contract a copy of his certificate of insurance as well as a copy of his identity document.
By making a reservation through "IAORANA AGENCY" or any intermediary website, the client agrees to respect and honor this entire contract without any restrictions.
